Complaints under Reg. 261/2007: rights of disabled persons and persons with reduced mobility
Enac, as the National Enfrocement Body in Italy, is tasked with ensuring the proper implementation of EU Regulation (EC) No. 1107/2006, which safeguards the rights of individuals with disabilities and reduced mobility in air transportation. It holds the authority to levy administrative sanctions against entities that fail to comply with these regulations.
The protections outlined in Regulation apply to:
- Flights departing from EU airports, regardless of destination or air carrier;
- Flights departing from non-EU airports and arriving at EU airports, if operated by an EU air carrier.
Under the Regulation, Iceland, Norway, and Switzerland are treated on par with EU Member States.
Regulation (EC) 1107/06 guarantees individuals with disabilities and reduced mobility the right to receive dedicated assistance, enabling them to travel by air under conditions equivalent to those of other passengers. This assistance must be provided both at the airport and onboard, with the necessary personnel and equipment, and at no additional cost.
The assistance prescribed by Regulation 1107/06 must be furnished by the airport managing body on-site and by the air carrier while on board.
According to Regulation (EC) 1107/06, individuals whose mobility is hindered due to physical disability, mental disability, or any other impairment requiring special attention and service adjustments may be considered Persons with Reduced Mobility (PRMs).
Specifically:
- Elderly individuals are categorized as PRMs, regardless of other health conditions or disabilities.
- Obesity and pregnancy, while not inherently considered disabilities, fall under PRM status only if specific conditions restrict mobility.
- Infants may also be covered by the protections outlined in EU Regulation (EC) 1107/2006.
