Category Complaints under Reg. (EC) 261/2004: long delay, cancellation and denied boarding

What are my rights if my flight has been delayed?

Regulation (EC) 261/04 safeguards passengers' rights in the event of long delays from the scheduled departure time (of at least 2 hours), entitling passengers to receive assistance commensurate with the delay duration and flight length.

Moreover:

- If a flight experiences a delay of at least 5 hours at departure, the air carrier must offer passengers the option to cancel the flight without penalty and obtain a refund for the unused portion of the ticket. Should passengers opt for this choice, their entitlement to assistance extends only until the point of flight cancellation.

- Passengers who reach their destination three hours later than the published arrival time may also be eligible for compensation, subject to specific conditions. However, compensation is not applicable in cases where the delay arises from exceptional circumstances beyond the air carrier's control, such as adverse weather conditions or certain instances of strikes.
